Preparing for Major HIPAA Changes in 2022

Please join Andrea Linna and Jonathan Ishee as they discuss proposed changes to HIPAA and HITECH that may impact covered entities and business associates. Earlier this year, the Department of Health and Human Services published proposed modifications to HIPAA and HITECH. Covered entities and business associates should prepare now for an overhaul of their HIPAA policies and protocols in 2022. These modifications will impact all covered entities and business associates, requiring updates to policies, procedures, security standards, notices of privacy practices, authorization and disclosure forms, and business associate agreements, among other things.

This webinar will focus on helping covered entities and business associates prepare for possible changes to:

  • The patient acknowledgment of notice of privacy practices
  • The minimum necessary standard
  • Allowable disclosures related to care coordination and case management
  • Disclosures for health emergencies
  • Individuals’ rights to access their protected health information (PHI)
  • Fees charged for access to PHI

Andrea and Jonathan will also discuss the newest changes to HITECH under HR 7898 and proposed changes to the National Institute of Standards and Technology “recognized cybersecurity practices,” which covered entities and business associates should incorporate into their cybersecurity framework.

Andrea Lee Linna represents clients at the intersection of healthcare, innovation, and technology. Andrea advises investors, healthcare providers, and healthcare technology companies on mergers and acquisitions, data privacy and security, regulatory requirements, healthcare IT, and fraud and abuse.

Andrea has substantial experience counseling telehealth, digital health, and technology companies on federal and state telemedicine regulations, state licensure and medical malpractice requirements, reimbursement, online prescribing, corporate practice of medicine, HIPAA, and developing and negotiating service agreements.

Andrea frequently speaks and writes about emerging healthcare and technology topics. She has been quoted by CNBC and Crain and has given guest lectures on health care law at Northwestern Pritzker School of Law, the University of Michigan School of Public Health, Loyola University School of Law, and the Wharton School of the University of Pennsylvania.

 

Jonathan M. Ishee

Jonathan focuses his practice on clients in the healthcare and technology industries. His previous in-house, government, and academic experience provide him with a unique perspective when providing legal services. Jonathan advises clients on regulatory issues, data privacy and security, and the use of technology and in the transformation of healthcare delivery and reimbursement.

Jonathan has significant experience with health care laws including HIPAA, managed care contracting, CMS and state insurance licensing, telehealth, corporate practice of medicine, and fraud and abuse issues. He also counsels nonhealthcare clients on international privacy regulations surrounding employee and research data.

Jonathan serves as an assistant professor of biomedical informatics at the University of Texas Health Science Center at Houston School of Biomedical Informatics. He is also a member of the International Association of Privacy Professionals and is a Certified Information Privacy Professional (CIPP).
