Many employers are aware of the need for HR essentials and HR representations. However, not all Employers have the bandwidth and budget to have qualified HR professionals as part of their team. Additionally, it is critical for all Employers who do have HR support to ensure their HR professionals and their managers to be up to date on all the trending employment law regulations. The goal is to have all HR and managers to be well versed on workplace regulations since it impacts the Employer risk management strategy. I call this the cost of non-compliance. This cost can go up to thousands of dollars if there are violations, fines, penalties, and even criminal sanctions.

The following workplace regulations are trending at Federal, State (multi-state), and local levels:

  • Department of Labor (DOL) Overtime, Wage and Hour, of the clockwork and independent contractor vs employee violations
  • Equal Employment Opportunity Commission (EEOC) Discrimination complaints, Retaliation and EEO-1 Pay Data Reporting
  • Criminal Background screening Ban the Box regulations
  • Pay Equity vs Pay Inequity
  • Marijuana in the workplace
  • I-9 Form Audits and Correction Process and the Department of Homeland Security (DHS) Raids
  • Drug-Free Workplace regulations
  • Salary history question prohibition in hiring practices
  • Paid Leave/Unpaid Leave
  • Employee Handbook updates based on all new regulations
  • Payroll compliance gaps
  • Concerted Activity and How the National Labor Relations Board help Employer

This training includes step-by-step internal audits for Employers that can be conducted by HR professionals. Employers and Managers. It will also include Employee Handbook updates that must be included, HR processes that must be updated, policies, and posting requirements. Additionally, Employers and their representatives will have an opportunity to create a 25 Step Audit Checklist to ensure compliance in all aspects/departments. Employers will have the chance to review a new software platform for all types of compliance needs.

Course Objectives:-

All the regulatory agencies listed are now collaborating with other agencies in their quest to identify companies that are violating current regulations. Prior to this, all regulatory agencies stayed in their lane and worked in silos.  With these new collaborative efforts, it is more likely that Employers will be targeted for audits. It is critical for employers to arm themselves and their teams with the training and tools they need to be compliant with all the regulations (the list does not represent all the employment law compliance). The training will include additional compliance and violation.

  • DOL
  • DHS
  • Immigration Customs Enforcement (ICE)
  • NLRB
  • Wage & Hour Division
  • Federal Labor Standards Act (FLSA)
  • Family Medical Leave Act (FMLA)
  • Retaliation
  • American with Disabilities Act (ADA)
  • Reasonable Accommodation Requirements

  • What employment laws are trending and proposed in 2020
